Terms and Conditions for Ticket Sales

for the sale of goods (tickets) via the online store available at www.sixartticket.pl

1. Preliminary Provisions

The Terms and Conditions (hereinafter referred to as "Terms and Conditions") of RESTARTSTAGE PRODUCTION – FZCO, odštěpný závod with registered office in Praha, Tax ID: 22161104, registered in the commercial register under number 22161104 District Court in Praha (hereinafter referred to as "Seller") regulate, in accordance with the provisions of § 1751 para. 1 of Act No. 89/2012 dated April 9, 2012, Civil Code (hereinafter referred to as "Civil Code"), the mutual rights and obligations of the parties to sales contracts (hereinafter referred to as "Sales Contract") concluded between the Seller and another natural person (hereinafter referred to as "Buyer") through the online store operated by the Seller. The online store is operated by the Seller on the website located at www.sixartticket.pl (hereinafter referred to as "Website").

These Terms and Conditions and the complaints procedure define and specify the rights and obligations of the Seller and Buyer in the sale of tickets for all types of cultural, social, sports or other events (hereinafter referred to as "Events") through the online store operated on the Website.

Contacting the Seller means contacting an authorized person by telephone at their specific telephone number or email address, if available to the Buyer, or at the general telephone number or email address provided in the "Contact" section on the Website.

These Terms and Conditions form an integral part of the Sales Contract concluded between the Buyer and the Seller. By purchasing tickets, the Buyer simultaneously confirms that they have read these Terms and Conditions and expressly acknowledges that they form part of the contract between them and the Seller.

2. Subject of the Contract

The subject of the contract is the Seller's obligation to deliver to the Buyer tickets in the requested quantity for the Event of their choice and the Buyer's obligation to pay the ticket fee to the Seller.

The Sales Contract is concluded when the Buyer makes payment for the tickets.

The Seller undertakes to deliver the tickets to the Buyer without undue delay after payment for the tickets, whereby in the case of online purchase, the tickets will be delivered in electronic form to the email address provided by the Buyer. The Buyer is not entitled to receive the tickets before the full amount for the Event ticket has been credited to the Seller's bank account.

Delivery of tickets to the Buyer by the Seller fulfills all obligations of the Seller arising from the Sales Contract.

Tickets are not sent by mail, nor are they delivered cash on delivery.

3. Rights and Obligations of the Parties in Connection with the Event for which Tickets were Purchased

The Seller is the organizer of the individual Events for which tickets are sold. The purchase of a ticket for an Event creates a legal relationship between the Buyer and the Seller as the organizer of that Event. The Seller is responsible for fulfilling the obligations of the event organizer arising from the contract between the Buyer and the Seller as the Event organizer.

By purchasing a ticket, the Buyer undertakes to comply with the rules established by the Seller as the Event organizer. Furthermore, by purchasing a ticket, the Buyer undertakes to comply with the operational and order regulations of the venue where the Event takes place.

The organizer, i.e., the Seller of each Event, has the right to change its program, date and venue. By purchasing a ticket, the Buyer is aware of this right of the Seller as organizer.

The Seller is not responsible for the validity and authenticity of tickets purchased outside the Seller's Website.

4. Ticket Purchase Procedure and Payment Terms

The price of each ticket is listed individually for each Event. Any additional fees associated with the ticket purchase are also listed for each Event.

When purchasing a ticket through the Website, payment for the ticket is only possible by payment card enabling online card purchases or by bank transfer to the Seller's bank account.

The Seller is not responsible for any costs incurred by the Buyer in connection with the ticket purchase arising from the contract between the Buyer and the bank that issued the Buyer's payment card or that maintains the Buyer's bank account through which the ticket payment was made.

Tickets are not sent cash on delivery.

5. Withdrawal from the Contract

In accordance with the provision of § 1837 letter j) of Act No. 89/2012 Sb., Civil Code, as amended, the Buyer is not entitled to withdraw from the contract concluded between them and the Seller in accordance with the provisions of § 1829 of the Civil Code (withdrawal from the contract within 14 days without giving reasons), as this is a contract concerning the use of leisure time and the service is provided by the entrepreneur, i.e., in this case the Event organizer, at a specified time.

6. Complaints Procedure

All complaints regarding tickets purchased through the Website are subject to these Terms and Conditions and the complaints procedure set out in this Article 6.

The Buyer is entitled to a refund of the ticket fee only in the following cases and under the following conditions.

The Buyer is not entitled to exchange the ticket. In case of damage, destruction, loss, theft or other depreciation of the ticket, the ticket will not be replaced with a new one, and the Buyer will not be compensated.

The Seller bears no responsibility for the inability to deliver the ticket to the Buyer due to the Buyer's actions or omissions, in particular due to the inability to deliver the ticket to the email address provided by the Buyer (e.g., full mailbox, spam filter, etc.).

If the Buyer has not received the ticket at the latest within 2 hours of full payment for the ticket, i.e., from the crediting of the full ticket price to the Seller's account, they are obliged to contact the Seller immediately, but no later than within 48 hours after the expiry of the above-mentioned ticket delivery deadline, and inform them that they have not received the paid ticket. For this purpose, the Buyer is obliged to provide the Seller with their name and email address, which they provided as contact or identification data when purchasing the ticket. If the Seller determines that the ticket was indeed not delivered to the Buyer, the procedure will continue according to the method described below in point 5.

The Seller undertakes to resend the ticket to the Buyer at the latest within 24 hours, but no later than 1 hour before the start of the Event, to the email address provided by the Buyer.

If the Event has already taken place, the Seller undertakes to refund the ticket fee to the Buyer no later than within 14 days from the date of the Buyer's complaint.

In the event of inability to hold the Event due to force majeure (e.g., natural disaster, strikes, war, mobilization, uprising, pandemic, etc.), the Seller reserves the right to postpone or completely cancel the Event. In case of postponement of the Event to another date, the ticket remains valid for this changed date, and the Buyer is not entitled to a refund of the ticket fee or to exchange the ticket.

If the Seller, as the organizer, changes the date or completely cancels the Event, the Buyer who has provided the Seller with their contact (email, telephone, postal address, fax, etc.) will be notified of the cancellation of the Event via this contact. The Seller is not responsible to the Buyer if the Buyer cannot be contacted in time via this contact or if the Buyer receives notification of the cancellation of the Promotion sent on time and with delay. The Seller is also not responsible if this information is not passed on to a third party in a timely manner.

In case of complete cancellation of the Event by the organizer as the Seller, the ticket fee will be refunded in full as described below.

If the conditions for a refund of the ticket fee according to paragraph 8 of this complaints procedure are met, the fee will be refunded to the Buyer via the payment card used to pay for the ticket, or in case of payment by bank transfer, to the bank account from which the ticket fee was received. The refund of the full ticket fee to the Buyer will be made no later than within 14 days from the date of cancellation of the Event.

7. Personal Data Protection

The Seller processes the Buyer's personal data for the purpose of fulfilling the contractual relationship between them and the Buyer, in accordance with Art. 6 para. 1 letter b) of the General Data Protection Regulation of the European Parliament and Council of the European Union 2017/679 to the extent to which the Buyer has provided them; to the greatest possible extent these are: first name, last name, email address, telephone number and bank account number or payment card number. The minimum scope of personal data that the Seller reserves as a condition for concluding the contract and in which the Buyer is obliged to provide their personal data includes the following personal data: first and last name, email address. The bank account number or payment card number are stored without connection to other personal data in the accounting on the Seller's bank statements and are not further processed in any way.

In particular, these are the following specific purposes of personal data processing:

  • delivery of the ticket to the Buyer and sending information about changes concerning Events or tickets;
  • identification of the Buyer in case of handling complaints in accordance with the complaints procedure contained in Article 6.

The Buyer provides their personal data through the Website and BZUCO e-shop software. In case of incorrectly entered data (e.g., typos in the name or telephone number), the Buyer is obliged to contact the Seller in their own interest. The Seller stores personal data for as long as necessary, but no longer than 12 months, and then deletes the personal data. If the Buyer wishes to have their data deleted earlier, they can contact the Seller and request deletion of their personal data.

The Seller stores the email addresses of all Buyers indefinitely and uses them for sending commercial communications concerning Events. If the Buyer does not wish to receive commercial communications, they can opt out by replying to the email and stating that they no longer wish to receive any commercial communications; in such case, their email address will be removed from the mailing list. The Buyer can also contact the Seller directly if they do not agree to receive commercial communications.

The Seller keeps statistics on the number of tickets sold for individual Events in individual years. The personal data of Buyers serves as the basis for these statistics, but they are fully anonymized using BZUCO e-shop software and Buyers cannot be identified from them.

At Events organized by the Seller as the organizer, photographs and short audio-visual recordings are taken for the purpose of promoting Events on the Internet. The Seller strives to preserve the privacy of participants to the maximum possible extent during photography and filming. If the Buyer learns that they appear in any shot and are clearly recognizable in it, they can contact the Seller and request additional technical measures to help preserve their anonymity as a participant, especially through artificial blurring of their image.

The Buyer has the right to submit requests or complaints regarding the processing of their personal data to the Seller or to the Data Protection Authority at any time.

8. Final Provisions

If it turns out that any of the provisions of these Terms and Conditions and the complaints procedure is invalid or ineffective, this does not affect the validity and effectiveness of the remaining provisions of these Terms and Conditions and the complaints procedure, which are separate from the invalid or ineffective provision.

The Seller has the right to change these Terms and Conditions at any time.

All provisions of these Terms and Conditions and the complaints procedure and the contractual relationship between the Buyer and the Seller are governed by Czech law.
